Notice of Passing of an Official Plan and Zoning By-Law Amendment
Take Notice that the Council of the Township of Warwick has passed By-Law 105 of 2023 and By-Law 106 of 2023 on the 30th day of October 2023, under Sections 22 and 34 of the Planning Act, R.S.O. 1990, as amended.
The Proposed Official Plan and Zoning By-Law Amendment amends Warwick’s Official Plan (consolidated 2021) and Warwick’s Zoning By-Law 121 of 2012 to implement changes to enable Additional Dwelling Units within Single Detached, Semi-Detached, Rowhouse, and Townhouse dwellings on lots serviced by municipal water and sewage. It would also enable dwelling units in an accessory building (garage). These amendments are to conform to changes made to the Planning Act through Bill 23.
The Proposed By-Law affects all lands within the Township of Warwick that are on municipal services (sewer and water).
No Other Applications are being considered at this time.
Appeals to the Ontario Land Tribunal in respect of the By-Law may be made by filing with the CAO/Clerk of the Township of Warwick a written notice of appeal, not later than the 4th day of December, 2023, setting out the reasons for the appeal and accompanied by the Ontario Land Tribunal fee made payable to the Minister of Finance.
If a Person or public body did not make oral or written submissions to the Township of Warwick before the By-Law was passed, the person or public body is not entitled to appeal the By-Law to the Ontario Land Tribunal. Only individuals, corporations, and public bodies may appeal a By-Law to the Local Planning Appeal Tribunal. A Notice of Appeal may not be filed by an unincorporated association or group. However, a Notice of Appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the By-Law was passed, the person or public body made oral submissions at a Public Meeting or written submissions to Warwick Council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
No Key Map has been provided as this amendment affects all lands zoned Agriculture in the Township.
