Township of Warwick Notice of Passing of a Zoning By-Law

Take Notice that the Council of the Township of Warwick has passed By-Law 99 of 2023 on the 25th day of September 2023, under Section 34 of the Planning Act, R.S.O. 1990, as amended.

The Proposed Zoning By-Law Amendment amends Warwick’s Zoning By-Law 121 of 2012 to create definitions to regulate and enable the ability of landowners to sever a residential dwelling from farmland because of farm consolidation. This is further to policy updates to enable the process of Surplus Farm Dwellings approved with the recent Official Plan update in 2021. As this amendment affects all properties zoned Agriculture within the Township, no key map has been provided as this amendment is Township-wide.

The Proposed By-Law affects all lands within the Township of Warwick zoned Agriculture.

No Other Applications are being considered at this time.

Appeals to the Ontario Land Tribunal in respect of the By-Law may be made by filing with the CAO/Clerk of the Township of Warwick a written notice of appeal, not later than the 16th day of October, 2023, setting out the reasons for the appeal and accompanied by the Ontario Land Tribunal fee made payable to the Minister of Finance.

If a Person or public body did not make oral or written submissions to the Township of Warwick before the By-Law was passed, the person or public body is not entitled to appeal the By-Law to the Ontario Land Tribunal. Only Individuals, corporations, and public bodies may appeal a By-Law to the Local Planning Appeal Tribunal. A Notice of Appeal may not be filed by an unincorporated association or group. However, a Notice of Appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No Person or public body shall be added as a party to the hearing of the appeal unless, before the By-Law was passed, the person or public body made oral submissions at a Public Meeting or written submissions to Warwick Council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.

No Key Map has been provided as this amendment affects all lands zoned Agriculture in the Township.
